It's been over three years since she originally settled her custody issues with her ex husband, but now it looks like Kelly Rutherford is back to finding herself as the recipient of undesirable news from the family court.
The "Gossip Girl" actress has recently been fighting to get her two children back to the United States, as they've currently been living in France with their father, Daniel Giersch, but a judge has now given Kelly's ex permission to keep the little ones in his European hometown.
According to a report put out by TMZ on Tuesday (August 28), the ruling ordered that the children should stay in France since Kelly has a flexible enough schedule to travel back and forth while it is not as easy for Giersch to visit the Unites States since his visa has been revoked.
The court is still giving Rutherford rights to be with her two children, ages 5 and 3, half of the time, but, due to the long distance situation, the 43-year-old small screen star is said to feel that this compromise is almost impossible and reportedly plans to appeal the decision.
